This Privacy Policy (“Privacy Policy”) explains the collection, use, and disclosure of “personal information” by the Law Offices of Andrew A. Hecht (the "Office"). This Privacy Policy applies to the website www.hechtbizlaw.com (the "Website"). This Privacy Policy does not apply to services rendered by the Law Office of Andrew A. Hecht to its clients, which are subject to different privacy considerations as set forth in the engagement letter between such client and the Office, and the ethics rules applicable to attorneys.

This Privacy Policy also explains the Office's commitment to you with respect to the use and disclosure of non personal browsing and site usage data that the Website collects. That commitment is contained in a “Data Usage Policy,” below.

As used in this policy, “personal information” means information that would allow a party to identify you such as, for example, your name, address or location, telephone number or email address.

By accessing the Website, you are accepting and agreeing to the practices described in this Privacy Policy.

This Privacy Policy is based upon the Creative Commons privacy policy and is licensed under the Creative Commons Attribution 3.0 License. Should you copy or adapt all or any part of this Privacy Policy, you do so at your own risk and you agree that no attorney-client or other relationship exists between you and the Law Offices of Andrew A. Hecht.

Principles

The Office is committed to handling responsibly the information and data is collected about you through the Website, whether personal information or non personal browsing and site usage data. The Privacy Policy and the Data Usage Policy have been designed consistent with the following principles (the “Principles”):

  1. Privacy policies and data collection and use policies should be human readable, comprehensive, and easy to locate;
  2. Only the minimum amount of information reasonably necessary to provide you with services should be collected and maintained, and only for so long as reasonably needed or required; and
  3. Personal information you provide through the Website, or that the Office gathers as a result of your use of the Website, should not be used for third party marketing or advertising purposes, nor should it be provided voluntarily (without your permission) to anyone else unless required.

Personal Information

The Office may collect personal information when you provide your personal information, such as by sending an email inquiry through the Contact page, or when you contact the Office directly using the phone or address information provided through the Website.

By using the Website, notwithstanding the collection of certain personal information, you agree that the Law Offices of Andrew A. Hecht will not represent you as counsel until such time as an engagement letter on mutually acceptable terms is entered into between you and the Law Offices of Andrew A. Hecht.

What the Office does with Personal Information

The Office uses the personal information you provide to it when you send an email inquiry through the Contact page, or when you contact the Office directly using the phone or address information provided through the Website, in order to determine whether the Office may be able to provide legal or other services to you.

Disclosures of Personal Information

In general, it is not the Office’s practice to disclose personal information obtained through the Website with third parties. The Office may share such personal information in two instances:

First, if you request, the Office may share your personal information with other providers who may be able to provide services to you instead of, or in conjunction with, the Office.

Second, to the extent not inconsistent with ethical obligations applicable to attorneys, the Office may elect in its sole discretion to disclose your personal information to third parties in a good faith belief that such disclosure is reasonably necessary to (a) take action regarding suspected illegal activities; (b) enforce or apply the Terms of Use and Privacy Policy; (c) comply with legal process, such as a search warrant, subpoena, statute, or court order; or (d) protect the rights, reputation, and property, or that of the Office's clients, users, affiliates, or the public.

Security of Personal Information

The Office has implemented reasonable measures to protect against unauthorized access to and unlawful interception or processing of personal information that the Office stores and controls. However, no website can fully eliminate security risks. Third parties may circumvent the Office's security measures to unlawfully intercept or access transmissions or private communications. You should not use the Website to transmit confidential, proprietary or other sensitive information.

Data Usage Policy: Non Personal Browsing and Site Usage Information

This Data Usage Policy covers how the Office maintains and uses information about you that is collected by the Website and server logs.

Non Personal Browsing Information. When you use the Website, the Office's servers (which are hosted by a third party service provider) may collect information indirectly and automatically (through, for example, the use of your “IP address”) about your activities while visiting the Website and information about the browser you are using.

No Linking. The Office does not intentionally link browsing information or information from server logs to the personal information you submit. The Office uses this information for internal purposes only, such as to help understand how the Website is being used, to improve the Website and the features it provides, and for systems administration purposes. The Office may use a third party analytics provider to help collect and analyze non personal browsing information through operation of the Website for those same purposes.

No Selling or Sharing. Except in the unique situations identified in this Privacy Policy, the Office does not sell or otherwise voluntarily provide the non personal browsing information it collects about you or your website usage to third parties.

Any other non-personal information that the Office collects which is not described specifically in this Privacy Policy will only be collected and used in accordance with the Principles.

Reorganization

The Office may transfer some or all of your personal and/or non personal browsing information to a third party as a result of a reorganization, merger of firms or other similar transaction. In such event, the Office will use reasonable efforts to notify you and to ensure that at the time of the transaction your personal information remains subject to a privacy policy that complies with the Principles. If you are a client of the Office, your engagement letter may set forth additional terms regarding any such transaction.

Third Party Sites

The Website may include links to other websites. You should consult the respective privacy policies of these third-party sites. This Privacy Policy does not apply to, and the Office cannot control the activities of, such other websites.

International Visitors

The Website is hosted in the United States. If you are accessing the Website from Latin America, Asia, the European Union or any other region with laws or regulations governing personal data collection, use and disclosure that differ from United States laws, please note that you are transferring your personal data to the United States which does not have the same data protection laws as the EU and other regions. By providing your personal data you consent to:

  • the use of your personal data for the uses identified above in accordance with the Privacy Policy; and
  • the transfer of your personal data to the United States as indicated above.

Changes and Updates to this Privacy Policy

The Office may occasionally update this Privacy Policy. When it does so, the Effective Date above will be changed. You are encouraged to periodically review this Privacy Policy to stay informed about how the Office is protecting the personal information it collects. Your continued use of the Website constitutes your agreement to this Privacy Policy and any updates.
